CARD HOLDER TERMS AND CONDITIONS


BETWEEN:     Any cardholder or user of an AWOP cashless chip at a specific Event.


AND              AWOP SMARTCARD TECHNOLOGY LIMITED (“AWOP”)


BACKGROUND:
AWOP provides cashless systems for events along with cash management and Point of sale systems using RFID smartcards.


THE PARTIES AGREE:
 

DEFINITIONS AND INTERPERTATION
Vendor means the Vendors authorised to be on site at the Event to provide either goods and/or services at the Event, utilizing the AWOP equipment, systems and technology. This includes AWOP.


AWOP Transaction means an AWOP authorised transaction, utilizing AWOP supplied equipment and technology which permits the Cardholder to transact and interact at the Event via the AWOP Chip.

 

AWOP transactions includes, but is not limited to, loading credit, redeeming credit or other items, purchasing goods and/or services. The Cardholder and Vendor are both present at the transaction.
 

Cardholder means a person who is in possession of an AWOP Chip and then users the AWOP Chip for AWOP transactions at the event. For this Agreement also means Wristband.
 

Card means a medium that has an AWOP chip in it that can be used to transact onsite at an event and includes wristbands, cards and other objects where an AWOP approved chip has been applied.
 

Equipment means all of the equipment supplied by AWOP to facilitate the delivery of the Services for the contracted period to the Event to enable Vendor and Cardholder participation at the Event.
 

GST means Goods and Services Tax or similar tax payable in New Zealand.
 

The Services means the electronic, end to end cash management services that are delivered by AWOP and may include gate entry management, alcohol compliance management, social media applications as required
 

Event means the event where the AWOP card was obtained for use
 

Venue means the location of the Event.


THE SERVICES
(i) AWOP shall supply RFID cards to an Event for use at the Event to enable users attending to transact with Vendors for goods or services.


(ii) Each approved Vendor shall be provided with either a POS Reader or AWOP Equipment to be able to perform AWOP Transactions for transacting the sale of goods and/or services with AWOP users at the Event.


(iii) Cardholders shall first load money onto their AWOP card which may then be used to transact for goods or services onsite.


(iv) The AWOP card is a debit only card and no credit shall be provided


(v) AWOP cards may be loaded with cash, eftpos and credit card. Fees may apply for credit card transactions.


(vi) Events may charge a first time load fee for cardholders to use the AWOP system, this fee is set by the event and collected by AWOP.


(vii) Events may charge a bond where AWOP cards are used and where applicable this bond is returnable to the customer upon return of the card in good condition during event hours only.

(viii)  Refunds shall be available to a cardholder who has funds remaining on their card at the event

(ix)  Refunds shall be available in cash at all times the Event is operational at no charge to the Cardholder.

(x)  Refunds may be provided post Event via the AWOP portal at the events discretion. A fee may be administered to cover the cost of bank fees and implementation of the online refund portal, details of any fees will be on the refund page prior to the event commencing. These fees shall be know as "Bank fees"

(xi)  AWOP holds no liability for events who do not wish to provide refunds.

(xii)  All unclaimed funds at the end of the refund period are returned to the Event and AWOP holds no liability for refunds not claimed before the end of the refund period

(xiii)  The refund period shall be advertised onsite at the event on AWOP kiosks and on the website refund portal www.awop.co.nz/refunds

(xiv)  AWOP holds no liability for refunds claimed against the wrong event.

(xv)  AWOP holds no liability for incorrect bank accounts or chip numbers entered into the refund portal and charges may apply to fix application details and AWOP makes no guarantee that an application can be changed once it is submitted.

(xvi)  Cardholders must retain their card for the duration of the refund period if an online refund is applied for and must provide it to AWOP if requested at the cardholders cost.

(xvii) DISPUTED TRANSACTIONS

 

  • AWOP holds no liability for disputed transactions unless AWOP is the vendor.

  • Disputed transactions between a cardholder and a vendor shall be handled with support of AWOP onsite at the event.

  •  AWOP can provide a list of transactions to a cardholder at any time and any disputed transactions between the vendor and the customer shall be handled with both parties present. 

  • AWOP will support the cardholder and the vendor with all disputed transactions to assist with resolution. 

  • AWOP cannot guarantee transactions disputed by a cardholder with a vendor shall reach resolution in the cardholder's favour.

  • For transactions disputed after the event AWOP shall make all attempts to put the vendor and the cardholder in contact and identify the disputed transaction and any dispute shall be between the cardholder and the vendor.

  • If the transaction dispute is with AWOP as the vendor then AWOP shall make all efforts to reach resolution with the customer as soon as the dispute is brought to AWOP's attention.

  • A valid chip number must be provided for all disputed transactions.    

(xviii)  AWOP cards are not re-usable between events unless otherwise stated and cards or wristbands are only valid at the event they were obtained at.

(xix)  Alcohol management systems may be used on Wristbands or cards and AWOP holds no liability to any person who is restricted from the purchase of alcohol at an event.

(xx)  All transactions using the AWOP system are inclusive of GST and should a cardholder wish to get a GST receipt they must do so at the individual vendor where the money has been spent.

(xxi)  AWOP hold no liability or responsibility for lost, stolen or broken cards.

(xxii)  AWOP holds all event funds in Trust accounts until such time that they are paid to the Vendor or claimed as a refund or paid to the event as unclaimed funds.

(xxiii)  AWOP reserves the right to deal with suspected fraudulent transactions as it sees fit and shall block a card suspected of misuse AWOP holds no liability for a card that is blocked through suspected misuse.

(xxiv)  Card transaction history is available on request to cardholders the card number must be provided to give a transaction history

(xxv)  AWOP may apply charges for card usage outside the normal terms of use

(xxvi) REFUNDS

If refunds are required they will be provided to either Vendors and/or Cardholders during the opening hours or the Event and up to an hour after the close of the Event;

A refund shall be paid to a Cardholder when the Cardholder has credit on their AWOP chip which the wish to redeem as follows:

      a)            Onsite refunds will be provided in cash;

                b)           Vendors are not permitted to issue refunds;

                c)            Refunds will be available as specified by the event and as per the event refund                                         portal on the AWOP website.

                d)           Online refunds shall incur a transaction fee of up to $1

 

(xxvii) PAYMENT FEES AND COSTS

  1. AWOP may charge a first time top-up fee to customers for the provision of the AWOP services.

  2. AWOP may charge DPS costs for credit card transactions to recover the cost of loading currency onsite.

  3. AWOP may charge an online refund transaction fee for all online transactions.
